$15,000 Bail Set for Local Man Charged With Marijuana Sale

Doug1as Kenny, 23, of 41 Prospect Ave., Saranac Lake is in Franklin County Jail on  $l5,000 bail facing a charge of criminally selling a dangerous drug, marijuana, in the first degree which constitutes a felony.

Kenny's attorney, Wyngar Dugan of Saranac Lake, said today that "Kenny when he heard that the police were looking for him, voluntarily surrendered himself to the State Police through myself," and that the amount of marijuana allegedly sold is small.

He was then arrested at 8:30 p. m. Wednesday by State Trooper Paul Scapatici who with Trooper John Fountain is continuing the investigation.

Kenny was arraigned before acting Saranac Lake Police Justice Karl Greibsch and requested an examination. At the request of Assistant Franklin County District Attorney Joseph Duffy, Griebsch then set 7 p.m., Saturday for the preliminary hearing.

Dugan objected strenuously to the amount of bail calling it excessive and arguing that if his client had any intention of fleeing jurisdiction he would not have turned himself in.

However, today Duffy said "Bail is only to insure his appearance and I had information that led me to believe that it would have to be high to assure his appearance. You have to look at each case objectively."

Dugan said this morning that he was making an effort to secure money for the bail and also contemplating making a motion to have the amount of bail reduced.

As the matter stands now, two things could happen at the preliminary hearing: the charge could be dropped or Kenny could be ordered held for the grand jury which does not meet again until next spring.

In the latter case, the responsibility of raising, lowering or continuing bail would be with Franklin County Judge Ellsworth N. Lawrence.

Kenny, a graduate of Saranac Lake High School, was the leader of "The Persuaders," a rock and roll group that was popular with local young people several years ago. He is now with a new group which still uses The Persuaders name, and he gives guitar lessons…
